1. ABOUT REFRESH ART AWARD
Refresh Art Award was set up by a group of artists with the idea of providing an art competition that gives value for the entry fee and is also more financially inclusive to enter than others. As well a place to find information about the award artists and entrants, plus enter you work, the website functions as an art marketplace at certain times of the year. We pledge to give each entrant to the prize representation in the form of showing their work on our website, and making it available for sale at agreed times. Our mission is to provide representation and acknowledgement to everyone, rather than just to the selected few. We hope this will offer an alternative insight in to the true extent of contemporary art.
At the moment we still operate as a collective of freelance artists, but if the award is better run by incorporating it as a company then we will consider this in the future. We are fully independent, having no financial backing from brands, galleries, universities or any other body. We are committed to maintaining this structure, and the bonus is that it also means fewer people require access to your data.
2. THE DATA WE COLLECT ABOUT YOU
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
We may collect, use, store and transfer different kinds of personal data about you in order to provide a smooth service, or for our own statutory requirements. This is always password protected, with limited access. We use third party service providers for financial transactions, as well as to run our website and in these cases some data may be stored by them in encrypted and password protected areas. At the moment we use the services of Paypal, Google and Wix. We have grouped together the types of personal data we might come across as follows:
Identity Data includes first name, last name, title, date of birth.
Contact Data includes billing address, delivery address, email address and telephone number.
Financial Data If you choose to enter one of our competitions, and subsequently sell or buy work from our website we use a third party service provider to process your payment details, and also to pay you money where relevant. Currently this is Paypal, so we do not store, process or come in to contact with your card details ourselves.
Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us or our Sellers. We may keep transaction data for up to 7 years due to legal requirements for accounting, after which time it will be destroyed.
Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website. While we do not actively collect this data, the third parties might do.
Messaging Data includes messages sent to or received from entrants, buyers and Refresh staff.
Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences. When entering the Refresh Art Award, one of the services we offer is to promote you work and help with marketing. This will involve sharing your social media usernames and hashtags, with your work, on a range of social media platforms as well as our own site. You may opt out of this by writing to us at .
At the moment we do not collect or use Aggregated Data such as statistical or demographic data for any purpose.
We do not ordinarily collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences. Any information that you volunteer for purposes of describing or selling your work will just be treated as ordinary data.
3. HOW IS YOUR PERSONAL DATA COLLECTED?
We collect personal data through direct interaction with you. For example, the form you fill in when entering our competition or questions we ask when we are marketing your artwork, or any volunteered information when you contact us. We do not monitor website interaction or anything else that you do while you are on our site, and do not collect this data.
4. THIRD PARTY SOURCES OF DATA AND SHARING DATA
We also collect and share data as described below:
Cloud storage providers – our current website provider has cloud computing storage that securely stores all of our data, including entrant and customer details.
Email service providers - in order to send you marketing content and transactional emails, we share your details with our email service providers.
Social Media Platforms – Part of our package for Refresh Art Award entrants is that we market your work. A large part of this is on social media but we do not make your name and email address available to companies in order to advertise and market our services to you through other platforms on the internet (e.g. Facebook). We simply use any information that you have given us specifically for promotion and use our own accounts to show your work, with names and/or social media hashtags where relevant.
Analytics and Profiling Tools - we currently aren’t using any analytics or profiling tools to track how users use our website.
We do not conduct any online behavioural tracking.
MARKETING, ADVERTISING, PROMOTIONS
You may see your work on third party sites as part of advertising for The Refresh Art Award. This is part of the package that we offer you in exchange for your entry fee, as we are committed to providing as much exposure for entrants as possible. We will always credit you for this work, and provide links to contact you. You may opt out of this service by contacting us at but we hope that the majority of people will enjoy the boost in profile this service will bring to them.
We do not give your data to anyone for third party marketing purposes.
5. DATA SECURITY
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those who have a business need to know.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
You acknowledge that the Internet is not a completely secure medium for communication and, accordingly, we cannot guarantee the security of any information you send to us (or we send to you) via the Internet. We are not responsible for any damages which you, or others, may suffer as a result of the loss of confidentiality of such information.
